IS DELTA 8 LEGAL IN THE US?

The question of whether Delta 8 THC is legal in the United States is a fairly new one and is grounded in an amendment to the 2018 Farm Bill that legalized hemp and hemp products across the US. 

The Farm Bill limited hemp-derived products to a maximum level of 0.3% Delta 9 THC (the compound more traditionally known for getting you high, found in large amounts in marijuana) – but stated nothing around limitations for Delta 8. 

This is because cannabis and hemp plants have such naturally low levels of Delta 8 that it was not even accounted for under the legislation. 

As it stands, Delta 8 enjoys an ongoing legal status in 36 States (Georgia included) though it has been declared a controlled substance in 20 – see the below map from CBD Oracle to get a quick view:

Delta 8’s legal status in Georgia  

In Georgia, hemp-derived Delta 8 remains a legal product and it is open for use, possession, sale, distribution, and production for all good citizens among us.  Marijuana-derived Delta 8 products are illegal, but as you may have guessed, these are not the kinds of products we sell here at ATL Dispensary. Is Delta 8 legal to ship in the US?

YES – you are 100% able to ship Delta 8 THC products through the United States Postal Service legally without any fear of repercussions. In line with the Farm Bill act, the USPS actually provided clarification to their regulations around shipping Hemp products, stating they can safely and legally be shipped within the United States. 

Can you legally fly with Delta 8? 

Once again in many cases, the answer here is a resounding YES! It is legal to fly with Delta 8 products as long as you are flying to and from areas in which the substance is legal and your airline doesn’t have any specific rules against it. If you want to be doubly sure, check the map again, and you can always touch base with your airline if you really want to be sure. Of course, this applies to domestic flights only. You will want to check the status of Delta 8 if flying internationally; though countries such as Mexico for instance, which shares a similar status to hemp products, should be completely fine.
